Terms & Conditions for “Win a Cleaner for a Year” Competition

1. Introduction By entering the “Win a Cleaner for a Year” competition, you agree to comply with and be bound by these Terms and Conditions. The Competition is organized by OzKleen (Organiser) and its associated brands, all of which operate under the same entity or Australian Business Number (ABN) as OzKleen (Organiser).

2. Eligibility

• This Competition is open to individuals aged 18 years or older, residing in Australia.
• Employees, agents, and immediate family members of Organiser and its affiliates are not eligible to enter the Competition.

3. How to Enter

• To enter, participants must scan the QR code highlight where the qr code is shown and available provided or use the web link provided by OzKleen and complete the survey as outlined in the instructions.
• Participants who complete the survey in full will automatically be entered into the competition.
•  Only one entry per person is allowed. Any additional entries submitted by the same individual will be disqualified.
• Entry into the Competition is free, and no purchase is necessary.

4.  Consent for Communication

• By answering “I agree” to the question, “Do you agree to receive communications from OzKleen and associated brands?”, you consent to receiving newsletters and promotional communications from OzKleen and its associated brands. You may opt-out of these communications at any time.

5. Prize Details

• One winner will be selected to win a “Cleaner for a Year” service, valued at $5,000.
• The total prize value is capped at $5,000, which may be used to pay for weekly, bi-weekly, or monthly cleaning services at the discretion of the winner, within the stated budget limit.
• A schedule for the cleaning services will be agreed upon between OzKleen, the cleaner, and the winner. The frequency and duration of each cleaning session will align with the agreed-upon budget for weekly, bi-weekly, or monthly services. This schedule must be approved by OzKleen prior to implementation.

•  Any changes to the agreed schedule, whether permanent or temporary, must be submitted in writing to OzKleen by either the cleaner or the winner for approval.

6. Prize Usage and Limitations

• The $5000 budget can only be applied to cleaning services and cannot be exchanged for cash or used for other purposes.
• The winner may choose to receive weekly, bi-weekly or monthly cleaning services. The budget allocated for the services is capped at $5,000, which must be used within a 12-month period from the date of the first cleaning service.
•  If the cleaning services provided exceed the $5,000 prize value, the winner will not be responsible for covering the difference unless the excess charges arise directly from their own actions (e.g., requesting additional services not covered by the agreement).
• If the winner is held responsible for any overages or charges, this would only occur if due to their failure to comply with the service agreement, such as approving services that exceed the budget or schedule without proper authorization from OzKleen.
• The cleaning service will be provided by a third-party provider chosen by either the winner or OzKleen. If the winner selects their own provider, the chosen provider must be approved by OzKleen before any arrangements are made.

7. Winner Selection

Competition will remain open until the 24th day of September, 2025

• The winner will be selected through a random draw from all eligible entries received. The draw will take place on the 25th of September 2025, and the winner will be contacted by OzKleen via the contact details provided during the entry process.
• The winner has 7 days from the date of contact to claim the prize. If the prize is unclaimed after 7 days, a new winner will be selected.
• It is the winner’s responsibility to ensure their contact details are accurate and to regularly check for communications from OzKleen during the prize notification period.

8. Prize Delivery

Upon confirmation of the winner, the winner may choose their own cleaner, subject to approval by OzKleen. Alternatively, OzKleen will facilitate the arrangement of the cleaning services with the selected provider.

The prize must be used within one year from the date of the first cleaning service.

9. Privacy Policy

• Collection and Use of Personal Information: The Organiser respects your privacy and is committed to protecting your personal information. By entering this Competition, you consent to the collection, storage, and use of your personal information for the purposes of administering the Competition and contacting the winner. The information collected may include, but is not limited to, your name, contact details, and any other information you provide when entering the Competition.

• Use of Personal Information for Communications: If you opt-in to receive communications by answering “I agree” to the question “Do you agree to receive communications from OzKleen and associated brands?”, you agree to receive marketing materials, newsletters, promotional content, updates, and offers from OzKleen and its affiliated companies brands. You can unsubscribe or opt-out from receiving these communications at any time by following the instructions provided in the emails or by contacting OzKleen directly.

• Data Security: The Organiser takes reasonable steps to protect the personal information you provide against misuse, interference, loss, unauthorized access, modification, or disclosure. Despite these efforts, no method of electronic storage or transmission is 100% secure, and we cannot guarantee the absolute security of your personal information.

• Sharing of Personal Information: Your personal information will not be sold, rented, or otherwise disclosed to third parties except for the purposes of administering the Competition, facilitating communication from OzKleen, and fulfilling the prize obligations. Once the winner has been selected, relevant information such as phone numbers and email addresses will be sent to the cleaning service provider, as necessary to complete the service delivery related to the prize.

• Access to Personal Information: You have the right to access and request corrections to personal information held by the Organiser. If you wish to update or review your personal information, please contact OzKleen through the contact details provided.

• Retention of Personal Information: Personal information collected for the purpose of the Competition will be retained for as long as necessary to administer the Competition, fulfill the prize, and comply with legal obligations. If you opted in to receive communications by answering “I agree” to the question “Do you agree to receive communications from OzKleen and associated brands?”, your information will be securely held in our system to receive newsletters and marketing materials. If you did not opt in, your information will be deleted after the competition period.

• Consent and Updates: By entering this Competition, you consent to the collection and use of your personal information as outlined in this Privacy Policy. The Organiser reserves the right to modify or update this Privacy Policy.

10. General Terms

Competition runs from February 1st 2025 until September 24th 2025

• By entering this Competition, participants agree to abide by these Terms and Conditions and accept that the decision of the Organiser in relation to any matter concerning the Competition is final and binding.
• The Organiser accepts no responsibility for any technical failures or errors in the administration of the Competition.
• The competition will be closed to new entries after the last entry date of 24th of September 2025

11. Governing Law This Competition and these Terms and Conditions will be governed by the laws of Australia and subject to the exclusive jurisdiction of the courts in Australia.

13. Obligations and Enforcement of Terms

• Adherence to Budget and Schedule
Both the winner and the selected cleaner (or OzKleen’s recommended cleaner) must adhere to the terms of the service agreement, including:

• Budget Limit: The total value of the cleaning services provided must not exceed $5,000 (AUD) within a 12-month period.

• Schedule: The frequency and duration of each cleaning session must comply with the agreed-upon weekly, bi-weekly or monthly budget. This schedule will need to be approved by OzKleen and agreed upon by all parties (OzKleen, the winner and cleaning service).
• • Non-Compliance by Cleaner:
  If the selected cleaner fails to adhere to the agreed budget, schedule, or terms, the winner should immediately notify OzKleen. OzKleen will resolve the issue by terminating the agreement with the cleaner if necessary and assigning a new cleaner, chosen by OzKleen, at no additional cost to the winner. The winner will not be held responsible for the cleaner’s non-compliance or any resulting issues.

• • Non-Compliance by Winner:
  If the winner fails to adhere to the terms outlined in the agreement, including but not limited to inappropriate behavior towards the cleaner, or attempting to alter the agreed schedule or budget without communication and authorization from OzKleen, OzKleen reserves the right to cancel the cleaning service.
•  The winner will not be penalized or disqualified due to factors outside of their control, such as issues arising from the cleaner’s performance or availability.

14. Legal Action for Breach of Terms

Breach of Terms: Any breach of these Terms and Conditions, including failure to comply with the service agreement between the winner and the cleaner, may result in legal action. However, the winner will not be held responsible for actions or failures caused by the cleaning service provider. The parties (OzKleen, the winner, and the cleaning service) agree that any disputes that cannot be resolved amicably will be subject to mediation

• Termination of Service Agreement: In the event of any breach of terms by either party (the cleaner or the winner), OzKleen reserves the right to terminate the service agreement and provide the winner with an alternate cleaning provider or cancel the prize altogether if the breach is deemed significant. The winner will not be liable for any termination resulting from the cleaner’s failure to meet the agreed terms.
• Liability for Damages: OzKleen will not be liable for any damages arising from a failure to comply with the service agreement. The winner agreeS to hold OzKleen harmless from any claims, damages, or liabilities resulting from the breach of the Terms and Conditions.

15. Dispute Resolution

• Mediation: In the event of a dispute between the winner and the cleaner that cannot be resolved through communication, both parties agree to attempt to resolve the matter through mediation before pursuing any legal actions. The mediation will be conducted by a neutral third party agreed upon by both the winner and the cleaner, with the cost of mediation being shared equally.
• Governing Law: This agreement is governed by the laws of Australia, and any legal proceedings will be conducted in accordance with the laws of Australia.

16. Ceasing of Cleaning Services

• If the winner chooses to cease their cleaning services at any point during the 12-month period, they must provide written notice to OzKleen. Upon receipt of this notice, OzKleen will cancel the cleaning services. No replacement winner will be chosen, and the cleaning service will be terminated. The cleaning service will not be transferred to another applicant.

• Nothing in this Agreement affects your rights to terminate the cleaning service in the event that you reject the services under the Australian Consumer Law.

17. Payment Terms for Cleaning Services

• The $5,000 prize value will not be paid upfront to the cleaner or winner. Instead, invoices for each cleaning service provided will need to be sent directly to OzKleen’s accounts team. OzKleen will process the payment in accordance with the invoiced amount for each service provided, ensuring that the total value does not exceed the $5,000 prize limit within the 12-month period.
